Attorney Eneida Roman – “How Can I Give My Baby Boy My Fiancée’s Last Name?”

QUESTION:

I’m going to be getting married soon and we want to either add or change the last name of my son to my fiancée’s last name. We have talked about this and decided that we want to do it while my son is still little (11months). How would we go about doing this?

ATTORNEY ROMAN’S ADVICE:

You can only change his name if your fiance is the father of your child. You need to go to Probate and Family Court with the birth certificate with the father’s name, or with DNA evidence that he is the father in order to request a name change. There is a specific form for that and the court clerks can guide you as to the procedure.
