I need to get my daughter a passport to travel to Colombia in a few months. Her dad is in jail and he cant go in person to sign the application form. What do I have to do to get her a passport? Thank you!
ATTORNEY ROMAN’S ADVICE:
You can go to family court and request full legal and physical custody of your child. You need to explain to the judge that the father is in jail and you need to get a passport for the child. Moreover, you need to explain to the judge that you are concerned that you will be limited in making any major life decisions for your child with the limitation that you have, given that the father is in jail. Once he is out of jail he can file for joint custody, but at this moment it is in the child’s best interest for you to have a court order stipulating that you have full legal and physical custody. You can bring the order to the post office so that they can waive the requirement that the father is present for the application of the passport.
