QUESTION:

My ex and I have been separated for 5 to 6 years. We got married by court. My question is, do we still have to go through court for the divorce?

ATTORNEY ROMAN’S ANSWER:

In order for a divorce to be legal you need to go to court. However, many couples who agree on all the issues of custody and child support can go and get a divorce that is called an “uncontested divorce” meaning that you file the petition together and there is no fight, simply a separation agreement that you file with the divorce petition and you stipulate what you want and how you wish to separate, etc. Usually courts have sample separation agreements for people who do not have attorneys. It should be something relatively easy if you are both on the same page.
